Welcome to Lantway! These Terms of Service ("Terms") govern your access to and use of the Lantway website, services, and content (collectively, the "Service"). Please read these Terms carefully before using our Service.
By creating an account, making a purchase, or otherwise using our Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference into these Terms. If you do not agree to these Terms, you may not use our Service.
1. Description of the Service
Lantway is an assessment tool designed to provide informational guidance on Chinese entry requirements based on publicly available official policies.
IMPORTANT: You acknowledge and agree that:
- Lantway is not a law firm, a visa agent, or a government entity.
- The information provided does not constitute official legal or immigration advice.
- The Service provides information for preparatory and informational purposes only.
- The information is based on policies known to us at the time of your assessment, but these policies may be updated by official sources at any time.
- The results generated by our tool are not a guarantee of entry into China. The final decision to grant or deny entry rests solely with the Chinese immigration authorities at the port of entry.
Use of Artificial Intelligence
The Service may utilize artificial intelligence to summarize or present information. You acknowledge that any AI-generated content is for informational purposes only and is subject to the same disclaimers and limitations of liability as the rest of the Service.
2. Eligibility
To use our Service, you must be at least 18 years old and have the legal capacity to enter into a binding contract. By creating an account or using our Service, you represent and warrant that you meet this requirement.
3. User Accounts
To access certain features of the Service, you must create an account. By creating an account, you agree to:
- Provide accurate and current information as requested during the registration process.
- Maintain the confidentiality of your account password.
- Accept responsibility for all activities that occur under your account, whether or not you have authorized them.
- Notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
4. Purchases, Payments, and Refunds
A. Access Period and Usage Limits
Your purchase grants you access to the paid features of the Service for a specific period of time and/or a specific quantity of paid feature uses. The exact duration and usage limits of this paid access will be clearly stated on the checkout page before you complete your payment. Upon the expiration of this period, your account will automatically revert to a free status, and you will lose access to the paid features unless a new purchase is made.
B. Payments
Access to paid features requires a single, non-recurring payment which does not automatically renew. Payments are processed through our partner, Paddle, and by making a purchase, you agree to their terms and privacy policy.
C. General Refund Policy
Due to the immediate digital nature of our Service, all purchases are final and non-refundable, except as required by law.
D. Notice for Consumers in the European Union (EU) and United Kingdom (UK)
For customers in the European Union and United Kingdom, consumer law provides a 14-day withdrawal period for digital purchases. Because our service provides instant access to our digital content, you will be asked to formally agree to the service starting immediately upon purchase. By doing so, you acknowledge that the standard 14-day withdrawal period will not apply.
5. Intellectual Property
All content, text, graphics, logos, code, and software that are part of the Service are the property of Lantway or its licensors and are protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial use.
You may not copy, modify, distribute, sell, or lease any part of our Service or its content.
6. User Conduct and Restrictions
You agree not to use the Service in any way that:
- Is illegal, fraudulent, or harmful.
- Violates the rights of others.
- Attempts to reverse-engineer, decompile, or otherwise discover the source code of the Service.
- Uses any automated system (bots, scrapers, etc.) to access or scrape the Service.
- Provides false or misleading information in connection with your user account.
7. Feedback
We welcome any suggestions, ideas, comments, or other feedback you may have regarding our Service ("Feedback"). You agree that any Feedback you submit to us is voluntary, non-confidential, and non-proprietary.
You hereby grant Lantway a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, publish, distribute, and otherwise exploit such Feedback for any purpose, including for commercial purposes, without any compensation, attribution, or obligation to you. By submitting Feedback, you waive any and all rights to claim that our use of your Feedback infringes on any of your rights, including intellectual property rights.
8. Disclaimers and Your Role
The purpose of our service is to empower you to make informed decisions for your trip to China. Ultimately, you are responsible for ensuring all your travel documents are correct, complete, and valid for your travel dates. Lantway is dedicated to supporting you, but cannot replace your own diligence and responsibility. Your use of any information, templates, or links provided by the Service is at your own risk.
A. Service Provided "As Is"
Like most online services, our Service is provided on an "as is" and "as available" basis. While we strive for excellence, we cannot legally guarantee that the Service will always be uninterrupted or entirely free of errors. To be legally precise, this means we explicitly disclaim any warranties of merchantability, fitness for a particular purpose, and non-infringement.
B. Information and Official Sources
Our service is based on our interpretation of official government sources. Although we diligently monitor, interpret, and simplify official content, these policies can change without notice. We strongly encourage the best practice of a final verification using official sources before your departure. Therefore, we do not provide a legal guarantee on the absolute accuracy or timeliness of the information.
C. Affiliate Links
Our site may contain affiliate links, meaning we may earn a commission if you purchase a product or service we recommend, always at no extra cost to you. We only recommend services that we trust and we think are helpful to your scenarios, but we are not responsible for their offerings or terms.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Lantway and its founders, employees, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, or other intangibles, or for any costs related to disruptions to travel plans (including but not limited to cancellations or rebooking fees), denied entry, or any other related costs or losses, resulting from, including but not limited to:
- Your use of or inability to use the Service.
- Your reliance on information obtained from the Service.
- Any unauthorized access to or use of our servers.
In no event shall Lantway's total liability to you for all damages, losses, or causes of action exceed the greater of (a) the amount you paid for the Service giving rise to the claim, or (b) twenty U.S. dollars ($20).
10. Indemnification
You agree to indemnify and hold harmless Lantway and its affiliates from any claims, damages, losses, or costs (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Service.
11. Termination
A. Termination by You
You may terminate these Terms at any time by requesting the permanent deletion of your account. You can initiate this process either through the account management features available within the Service or by sending a formal deletion request to us at hello@lantway.com. Please note that this action is irreversible and will result in the deletion or anonymization of your personal information as described in our Privacy Policy.
B. Termination by Us
We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, if you violate any provision of these Terms.
C. Survival
Upon termination of these Terms, the following sections shall survive: Section 5 (Intellectual Property), Section 7 (Feedback), Section 8 (Disclaimers and Your Role), Section 9 (Limitation of Liability), Section 10 (Indemnification), Section 13 (Governing Law), and Section 15 (General Provisions).
12. Changes to Terms
We reserve the right to modify these Terms at any time. If we make changes that are material, we will provide you with at least 30 days' notice before the changes take effect. Notice will be provided by sending an email to the address associated with your account and/or by posting a prominent notice on our website. For non-material changes, we will simply update the "Last Updated" date. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the new Terms.
13. Governing Law
These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
Any dispute, controversy, difference, or claim arising out of or relating to these Terms, including the existence, validity, interpretation, performance, breach, or termination thereof, shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted.
The seat of arbitration shall be Hong Kong. The number of arbitrators shall be one. The arbitration proceedings shall be conducted in English.
You agree that by entering into these Terms, you are waiving the right to a trial by jury or to participate in a class action.
14. Force Majeure
We shall not be liable for any failure or delay in performance under these Terms for causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, or significant network failures.
15. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and Lantway regarding your use of the Service and supersede all prior agreements.
- Waiver: The failure of Lantway to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
- Severability: If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
- Assignment: These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Lantway without restriction.
