1. Introduction
Welcome to Lantway! These Terms of Service ("Terms") govern your access to and use of the Lantway website, services, and content (collectively, the "Service"). The Service is operated by Shanghai Wuyan Consulting Management Co., Ltd., a company registered in Shanghai, China, referred to in these Terms as "Lantway", "we", "us", or "our".
Please read these Terms carefully before using the Service. By creating an account, making a purchase, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference into these Terms. If you do not agree to these Terms, you may not use the Service.
2. Description of the Service
Lantway provides structured content, action-oriented guides, and an assessment tool designed to help foreigners navigate China. The guidance provided through these features is based on our curation and interpretation of official information, practical field experience, and user-reported data.
Intended Audience
The Service is specifically designed for foreign nationals planning to travel to, or currently staying in, Mainland China. If you are a citizen of the People's Republic of China (including residents of Hong Kong, Macao, and Taiwan), please be advised that the Service is not intended for your use.
What You Acknowledge and Agree
- Non-Official Status: Lantway is a private service provider. We are not a law firm, a visa agent, or a government entity. While Lantway is dedicated to providing the most accurate and up-to-date guidance, the Service does not constitute legal or immigration advice, nor does it represent the official stance, policy, administrative interpretation, or mandatory instructions of the Chinese government, the National Immigration Administration (NIA), the Ministry of Public Security, or any Chinese consulate/embassy.
- No Guarantee of Entry: The Playbook Series, Resolution Articles, and the results generated by our assessment tool are not a guarantee of entry into China. The final decision to grant or deny entry rests solely with the Chinese immigration authorities at the port of entry.
- Nature of the Service: Nature of the Service: The Service is designed to simplify your preparation, entry, and stay in China, but is not an exhaustive encyclopedia. It provides action-oriented guidance for preparatory and informational purposes, but does not provide medical, legal, or emergency rescue services. Regarding healthcare and emergency procedures, it does not substitute for professional medical advice or emergency response.
- Timeliness: Information is based on official sources, practical field experience, and user-reported data known to us at the time of your use of the Service. While we strive to keep our guidance current, we cannot ensure that every policy change or operational update is reflected in real-time.
Use of Artificial Intelligence
Lantway’s core services—including the assessment tool, the Playbook Series, and Resolution Articles—are human-verified and curated. While we may utilize AI tools to assist in our research or editorial processes, every piece of content undergoes human examination and oversight.
Beyond these curated resources, AI-driven features (such as experimental tools or automated assistants) may be integrated into the Service to enhance user experience. Such AI-generated outputs are provided for informational purposes only. You acknowledge that all AI-assisted or generated content is subject to the same disclaimers and limitations of liability as the rest of the Service, and Lantway does not guarantee the absolute accuracy of purely AI-driven outputs.
3. Eligibility
To use the Service, you must be at least 18 years old and have the legal capacity to enter into a binding contract. If you are using the Service on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms, in which case the terms "you" and "your" shall refer to such entity. By creating an account or using the Service, you represent and warrant that you meet this requirement.
4. User Accounts
To access certain features of the Service, you must create an account. By creating an account, you agree to:
- Provide accurate and current information as requested during the registration process.
- Maintain the confidentiality of your account password.
- Accept responsibility for all activities that occur under your account, whether or not you have authorized them.
- Notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
- Entity Accounts: If your account is designated as an institutional, API, or Reseller account, you are responsible for ensuring that all personnel who access the Service through your credentials or API keys comply with these Terms. You are responsible for all usage fees incurred through your account, regardless of which individual performed the action.
5. Purchases, Payments, and Refunds
A. Access Period and Usage Limits
Your purchase grants you access to the paid features of the Service for a specific period of time and/or a specific quantity of paid feature uses. The exact duration and usage limits of this paid access will be clearly stated on the checkout page before you complete your payment. Upon the expiration of this period, your account will automatically revert to a free status, and you will lose access to the paid features unless a new purchase is made.
B. Payments
- Standard Online Purchases: For standard digital products, we currently use Paddle as our Merchant of Record. By making a purchase through Paddle, you agree to be bound by Paddle's terms and privacy policy, and you acknowledge that "Paddle" will appear on your billing statement.
- Institutional & Custom Solutions: For non-standard arrangements—including but not limited to API solutions, Reseller programs, specialized consulting, or bulk institutional licenses—payment terms (including invoicing, wire transfers, and payment schedules) will be governed by a separate written agreement or Order Form. In the event of any conflict between these Terms and such specific agreement signed by both parties, the specific agreement shall prevail.
- Pricing:
- Standard Rates: Fees for standard, self-service features are clearly displayed on our website and at checkout.
- Custom Quotations: Pricing for non-standard or high-volume services (like API access or Reseller tiers) is customized based on your specific needs and will be provided via a formal quote or contract.
C. General Refund Policy
Due to the immediate digital nature of the Service, all purchases are final and non-refundable, except where required by applicable consumer protection laws (such as those in the EU/UK).
D. Notice for Consumers in the European Union (EU) and United Kingdom (UK)
For customers in the European Union and United Kingdom, consumer law provides a 14-day withdrawal period for digital purchases. Because the Service provides instant access to our digital content, you will be asked to formally agree to the Service starting immediately upon purchase. By doing so, you acknowledge that the standard 14-day withdrawal period will not apply.
E. Termination for Cause (No Refund)
If your account is suspended or terminated by us due to your material breach of these Terms (including but not limited to unauthorized data scraping, account sharing, or fraudulent activity), you acknowledge and agree that you shall forfeit any unused portion of your paid access. You will not be entitled to any refund or compensation for such termination.
F. Termination for Convenience by Lantway (Pro-rata Refund)
Lantway reserves the right to terminate or discontinue the Service (or any part thereof) at any time. If Lantway terminates your paid access for convenience—meaning for reasons other than your breach of these Terms, legal requirements, security risks, or events of Force Majeure (as defined in Section 15)—Lantway will provide a pro-rata refund of the prepaid fees for the remaining unused portion of your paid access. This pro-rata refund shall be your sole and exclusive remedy for such termination.
6. Intellectual Property and Use License
A. Ownership
All content, text, graphics, logos, code, and software that are part of the Service are the property of Lantway or its licensors and are protected by copyright and other intellectual property laws.
B. Limited License
Unless otherwise agreed in a separate written agreement between you and Lantway:
- We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial use.
- You may not copy, modify, distribute, sell, lease, or reverse engineer any part of the Service or its content.
C. Institutional & Custom Use
If you wish to use the Service for institutional or commercial purposes, or if you are interested in our API solutions or Reseller program, you must contact us at contact@lantway.com to obtain a specific institutional or commercial license. Unauthorized commercial exploitation of the Service is a violation of these Terms.
7. User Conduct and Restrictions
You agree not to use the Service in any way that:
- Is illegal, fraudulent, or harmful.
- Violates the rights of others.
- Attempts to reverse-engineer, decompile, or otherwise discover the source code of the Service.
- Uses any automated system (bots, scrapers, etc.) to access or scrape the Service, except as expressly authorized through a signed API license agreement with us.
- Provides false or misleading information in connection with your user account.
- Interferes with or disrupts the integrity or performance of the Service.
Lantway does not encourage or condone the violation of any laws or regulations. The Service is for navigating situations within the bounds of the law as we understand it.
8. Feedback
We welcome any suggestions, ideas, comments, or other feedback you may have regarding the Service ("Feedback"). You agree that any Feedback you submit to us is voluntary, non-confidential, and non-proprietary.
To the extent permitted by applicable law, you hereby grant Lantway a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, publish, distribute, and otherwise exploit such Feedback for any purpose, including for commercial purposes, without any compensation, attribution, or obligation to you; and by submitting such feedback, you waive any and all rights to claim that our use of your Feedback infringes on any of your rights, including intellectual property rights.
9. Disclaimers and Your Role
The purpose of the Service is to empower you to make informed decisions for your entry into and stay in China. Ultimately, you are responsible for ensuring all your required documentation is correct, complete, and valid for the entire duration of your stay. Lantway is dedicated to supporting you, but cannot replace your own diligence and responsibility. Your use of any information, templates, or links provided by the Service is at your own risk. You remain solely responsible for your decisions and compliance with applicable laws.
A. The Service Provided "As Is"
Like most online services, the Service is provided on an "as is" and "as available" basis. While we strive for excellence, we cannot legally guarantee that the Service will always be uninterrupted or entirely free of errors. To be legally precise, this means we explicitly disclaim any warranties of merchantability, fitness for a particular purpose, and non-infringement.
B. Information and Official Sources
The Service is based on our interpretation of official sources, supplemented by practical field experience and user-reported data. While we endeavor to monitor, interpret, and simplify official content to provide you with reliable information, these policies can change without notice. Therefore, we do not provide a legal guarantee on the absolute accuracy or timeliness of the information.
As a final measure of due diligence, we strongly encourage a final verification using official sources before your departure or any change in your residency or visa status. While Lantway strives to be your primary preparation resource, you remain ultimately responsible for confirming the most current requirements for your specific destination through official channels.
Additionally, you acknowledge that airlines may have their own internal boarding requirements and document verification policies. You are ultimately responsible for verifying specific boarding and transit rules with your carrier(s) before travel.
C. Affiliate Links
Our site may contain affiliate links, meaning we may earn a commission if you purchase a product or service we recommend, always at no extra cost to you. We only recommend services that we trust and we think are helpful to your scenarios, but we are not responsible for their offerings, terms, or the security of their websites. Lantway is not a party to any transaction between you and third-party providers. Any disputes arising from third-party services (e.g., eSIM connectivity issues, insurance claims) must be resolved directly with the respective provider.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Lantway and its founders, employees, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, expenditures, or other intangibles, or for any costs related to disruptions to travel plans (such as cancellations or rebooking fees), denied entry, residency, relocation arrangements, or any other related costs or losses, resulting from, including but not limited to:
- Your use of or inability to use the Service.
- Your reliance on information obtained from the Service.
- Any unauthorized access to or use of our servers.
In no event shall Lantway's total liability to you for all damages, losses, or causes of action exceed the greater of (a) the total amount actually paid by you to Lantway for the specific service giving rise to the liability during the six (6) months immediately preceding the events giving rise to such liability, or (b) US$100 (or the minimum amount permitted by applicable law).
11. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Lantway and its affiliates from any claims, damages, losses, or costs (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Service.
12. Termination
A. Termination by You
You may terminate these Terms at any time by requesting the permanent deletion of your account. You can initiate this process either through the account management features available within the Service or by sending a formal deletion request to us at contact@lantway.com. Please note that this action is irreversible and will result in the deletion or anonymization of your personal information as described in our Privacy Policy.
B. Termination by Us
We may, in our reasonable discretion, suspend or terminate your account and access to the Service if:
(i) you materially violate any provision of these Terms;
(ii) we are required to do so by law or a governmental authority; or
(iii) we identify behavior that poses a security risk to the Service or other users.
We will provide you with reasonable prior notice before termination, unless the violation is severe or immediate action is necessary to prevent harm, legal liability, or disruption to the Service. The financial consequences of such termination (including whether a refund is applicable) are governed by Sections 5.E and 5.F of these Terms.
C. Survival
Upon termination of these Terms, the following sections shall survive: Section 6 (Intellectual Property), Section 8 (Feedback), Section 9 (Disclaimers and Your Role), Section 10 (Limitation of Liability), Section 11 (Indemnification), Section 14 (Governing Law), and Section 16 (General Provisions).
13. Changes to Terms
We reserve the right to modify these Terms at any time. If we make changes that are material, we will provide you with prior notice before the changes take effect. Notice will be provided by sending an email to the address associated with your account and/or by posting a prominent notice on our website. For non-material changes, we will simply update the "Last Updated" date. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the new Terms.
14. Governing Law
Reflecting the international nature of the Service and its delivery via infrastructure outside of Mainland China, these Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
Any dispute, controversy, difference, or claim arising out of or relating to these Terms, including the existence, validity, interpretation, performance, breach, or termination thereof, shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted.
The seat of arbitration shall be Hong Kong. The number of arbitrators shall be one. The arbitration proceedings shall be conducted in English.
You agree that by entering into these Terms, you are waiving the right to a trial by jury or to participate in a class action.
Notwithstanding the foregoing, if you are a consumer residing in the European Union, United Kingdom, or other jurisdictions with mandatory consumer protection laws, nothing in these Terms shall deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement by virtue of the laws of your country of residence.
15. Force Majeure
We shall not be liable for any failure or delay in performance under these Terms for causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, changes in government policies, the imposition of border control measures, sudden regulatory updates, or significant network failures.
16. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and Lantway regarding your use of the Service and supersede all prior agreements.
- Waiver: The failure of Lantway to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
- Severability: If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
- Assignment: These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Lantway without restriction.
- Language: The Service is provided in English. While we may provide translations for certain content, these are for convenience only. In the event of any conflict or inconsistency between the English version and any translated version, the English version shall prevail.
